Description

A proposed class action has been filed in the Supreme Court of British Columbia against TikTok Ltd. and related entities, including ByteDance Ltd. The lawsuit alleges that TikTok unlawfully collected, used, and exploited the personal data of Canadian users of its social media application—including children and teenagers—without valid consent.

The case is brought on behalf of all persons in Canada who used TikTok after October 28, 2021.

Privacy Regulators

In September 2025, Offices of Privacy Commissioners for Canada, British Columbia, Québec, and Alberta published the results of a joint investigation into the TikTok social media platform. The Commissioners found that TikTok has failed to protect user privacy in their collection and use of personal information. The investigation revealed that TikTok had fallen short in safeguarding user privacy—particularly for the hundreds of thousands of Canadian minors who use the app every year.

You can review the findings on the Office of the Privacy Commissioner of Canada website: PIPEDA Findings # 2025-003: Joint investigation of TikTok Pte. Ltd.
