$50,000 Awarded for Pain and Suffering for ongoing soft tissue injuries
Jesse Kendall was trial counsel for a 45-year old man who sustained injuries while riding as a passenger in a taxicab in 2014. Despite ICBC’s view that the plaintiff’s injuries warranted a significantly lower award, the Supreme Court of British Columbia found that an award of $50,000 would fairly compensate him for his pain and suffering, taking into account how his recreational capacities and general lifestyle have been impaired as a result of the accident.
