Another unfair low-ball offer from ICBC results in another win for RHE client

ICBC continues to make low-ball offers resulting in unnecessary trials.  RHE trial lawyers Tony Leoni and Ben Colangelo were counsel for Ingrid Libera in Libera v. Burgoyne, 2021 BCSC 1028. ICBC denied liability for an intersection accident despite evidence from an independent eyewitness confirming that the Defendant was at fault.  ICBC also retained, likely at significant cost to the ratepayer, an accident reconstruction engineer to provide evidence at trial.

Madam Justice Warren confirmed that our 25 year old client was not at fault for the accident, and provided a helpful analysis of the principles applicable on yellow light accidents involving straight through and left turning drivers.  Justice Warren awarded total damages of $102,825, including $90,000 in pain and suffering for moderate ongoing chronic pain.
