Triumph Over Adversity: Nafeesa Dhanji’s Journey to Justice and a $1.6 Million Award
Hector MacDonald and Anthony Leoni were trial counsel for Nafeesa Dhanji, a Field Support Manager at Telus who was left disabled as a result of a motor vehicle accident as a result of which she developed somatic symptom disorder as well as soft tissue upper back and shoulder tenderness and neck pain.
Mr. Justice Funt awarded Ms. Dhanji damages in the amount of $1,666,558 including $1,426,600 for future loss of earning capacity. The Defendants argued that the Plaintiff’s complaints were not credible or reliable, she had pre-existing condition and she failed to mitigate her damages. The Court rejected this argument finding that the Plaintiff’s complaints were credible and that she was a much different person than she was before the accident.
