Rice Harbut Elliott LLP and CFM Lawyers LLP have commenced a proposed class action against the Government of Canada on behalf of Indigenous persons who are serving a federal prison sentence or have served a federal prison sentence since April 17, 1985. The proposed class action alleges Indigenous persons have experienced and continue to experience discrimination (amounting to s.15 Charter breaches), unnecessary deprivations of liberty, and other serious harms as a result of Canada’s systemic misadministration of their sentences.

Overview

Rice Harbut Elliott LLP and CFM Lawyers LLP seek to recover compensation (including Charter damages) for Indigenous persons who are serving a federal prison sentence or have served a federal prison sentence since April 17, 1985.  The claim alleges that the manner in which Canada, through its operation of the Correctional Service of Canada (CSC), administers the sentences of federal offenders adversely impacts and disadvantages Indigenous offenders and has contributed to the overrepresentation of Indigenous persons in federal custody.  The claim alleges that CSC has systemically failed to provide access to culturally-informed correctional resources and Indigenous culture and spiritual practices, and has otherwise failed to take meaningful steps to address the inequities and disparate outcomes experienced by Indigenous offenders.  The proposed class action brings claims in negligence and also seeks damages pursuant to s.24(1) of the Charter for breaches of s.15 of the Charter.
