AFFF CLASS ACTION

Rice Harbut Elliott has filed a proposed Canadian class action seeking compensation for individuals (or their beneficiaries) who have been diagnosed with certain cancers and illnesses* after using or being exposed to aqueous film-forming foam (“AFFF”) containing chemicals (“PFAS”) which were manufactured by various 3M, DuPont and Tyco entities (the “Class Action”). AFFF containing PFAS manufactured by the defendants has been used in Canada for fire protection, training, and emergency response activities for many decades.

Class Action Details

This Class Action relates to the defendants’ wrongful manufacturing, marketing, and sale of AFFF containing PFAS, which the defendants knew or should have known caused serious risks to human health including the development of specific types of cancer and other illness. The claim alleges that the defendants:

– Withheld critical information about product toxicity. They knew about the risks of using products containing PFAS, including AFFF, for several decades before making such knowledge public.

-Failed to warn about the risks. They breached their duties as manufacturers and importers of PFAS in Canada by failing to adequately and in a timely manner warn purchasers and users of AFFF of the serious risks associated with the use of or exposure to PFAS.
