Rice Harbut Elliott LLP has commenced proceedings in an anticipated class action lawsuit, representing Canadian women who were prescribed “Alesse 21” or “Alesse 28” birth control pills, which were recalled by Health Canada in December 2017.

The case will now be proceeding to discovery and trial.
Overview
The affected “Alesse 21” or “Alesse 28” pills reportedly involved broken or smaller-than-normal pills, leading to unintended pregnancies. At present, the recall involves pills from the following lots, but it is not known at this time whether the issue is isolated to these lots:
Alesse 21 (DIN 02236974) Lot A2532, expires August 2018
Alesse 28 (DIN 02236975) Lot A3183, expires April 2019
Our firm is seeking compensation for Canadian women who received “Alesse 21” or “Alesse 28” birth control pills from the recalled lots, or other lots that may have been involved in the manufacturing defect. Damages will be sought both for women who experienced unintended pregnancies and other women who received pills that were recalled. The latter group may be entitled to compensation pursuant to B.C. consumer protection legislation.
